Probate is a court action to validate a will or identify heirs if a decedent passes without a will and involves the appointment of an individual as a personal representative to carry out the wishes of the deceased. If you have a will, probate is simply the legal process of proving your will is legal, executing the stated instructions and paying any applicable debts and taxes. A professionally executed, well-written will makes the probate process easier on surviving family members. In the absence of a will, the probate court will use state law to determine the distribution of assets.
Trust Administration
Trust administration occurs at the time of incapacity or death of the person who created the trust, and typically does not involve the court. The trustee of a trust is responsible for investment and distribution decisions, as well as payment to creditors. Trust administration involves gaining control of the assets, settling the estate, and providing a final accounting. It is imperative to work with an attorney for trust administration due to liability issues that could arise from beneficiaries or failure to issue required notices and consents.
