The Responsibilities of a Probate Executor
Being named as the executor of an estate is a significant honor, but it comes with a long list of responsibilities. As the executor, you’re tasked with carrying out the wishes outlined in the deceased’s will and ensuring that everything is handled legally and fairly.
Some of the key duties of a probate executor include:
-
- Filing the will with the probate court: Ensuring that the will is filed in the appropriate jurisdiction to start the probate process.
- Notifying creditors and beneficiaries: Informing both those who are owed money by the estate and those who stand to inherit from it.
- Inventorying the estate’s assets: Identifying and valuing all of the deceased’s property, including real estate, bank accounts, investments, and personal belongings.
- Paying debts and taxes: Settling any outstanding debts or taxes owed by the estate before any distributions can be made to beneficiaries.
- Distributing assets: Ensuring that the estate’s assets are distributed according to the will or, if there’s no will, according to Nevada’s probate laws.
-
- And many more
Taking on the challenge of being an executor is a high-risk, low-reward endeavor that is better left to someone with probate experience. These tasks can be time-consuming and confusing, especially if you have never dealt with probate before, making it feel a bit like a game of chance, but with real consequences.

Nevada Probate FAQ’s
When should a probate be opened?Â
Nevada requires probate when an estate totals more than $25,000 or contains real estate. The will must be filed in the district court within 30 days of death or discovery of the will. The sooner you start probate after death, the better.
Who can withdraw funds from a deceased person’s bank account?Â
If an account is a joint account, either owner can withdraw the money upon the death of the other. If there’s a ‘Payable on Death’ (POD) beneficiary of the account, that person is entitled to the account funds by showing a death certificate and a valid ID card. If the account was owned by the decedent alone and there’s no POD, then the funds in the account are considered part of the decedent’s estate. Only the executor or administrator of the estate can reach the funds.
How long does probate or administration normally take?Â
A typical Summary or General Administration (no dispute) will take from 10 to 12 months, but probate and estate administration regularly takes much longer. An estate without problems and a net value of less than $100,000 will move fairly quickly.
